People vs. King Modest, Ricardo Caldwell, and Devon Callicut

On October 20, 2008, 22 year-old SUNY Albany student Richard Bailey was shot and killed while walking home from a friend’s house on South Lake Avenue in the City of Albany.  While a witness had seen two young men riding their bikes away from the area, there were no other eye-witnesses and no evidence left at the scene.  With the assistance of several other law enforcement agencies, the Albany Police and the District Attorney’s Office spent the next  year investigating the case ultimately announcing the indictment of 3 individuals on November 22, 2009.  The prosecution resulted in the conviction of King Modest, Ricardo Caldwell, and Devon Callicut.  While Mr. Modest and Caldwell pleaded guilty prior to trial, Devon Callicut  was tried and convicted of Murder in the First Degree and was sentenced to Life Without the Possibility of Parole on February 3, 2011.

The case was prosecuted by Chief Assistant District Attorney Dave Rossi and Assistant District Attorney Steven Sharp.
