 Five Indicted In Connection to 


Gun Violence in Albany


  

    


ALBANY, NY- District Attorney P. David Soares announced today that five individuals were each indicted by an Albany County Grand Jury on charges relating to non-fatal shooting incidents that have occurred in the City of Albany in 2019.

BAHKEE GREEN, 18, of Albany and a 17-year-old, of Albany, were each indicted on (1) Count of Attempted Murder in the Second Degree, a Class B Violent Felony, (2) Counts of Assault in the Second Degree, each Class D Armed Violent Felonies, and (1) Count of Criminal Possession of a Weapon in the Second Degree, a Class C Armed Violent Felony.

The indictment alleges that on July 18, 2019, while in the area of Teunis Street and Third Avenue in the City of Albany, GREEN and the 17-year-old, while in possession of a loaded and operable pistol and with the intent to cause the death of another person, did attempt to cause the death of another person by shooting at him with a pistol. GREEN and the 17-year-old allegedly did recklessly cause physical injury to a three year old by intentional discharge of said pistol.

The same 17-year-old was also indicted on (1) Count of Criminal Possession of a Weapon in the Second Degree, (1) Count of Reckless Endangerment in the First Degree, a Class D Felony, and (1) Count of Tampering with Physical Evidence, a Class E Felony. The indictment alleges that on July 2, 2019, while in the area of 158 Third Avenue in the City of Albany, the 17-year-old did recklessly engage in conduct which creates a grave risk of death to another person while in possession of a loaded and operable pistol. Additionally, the 17-year-old allegedly intended to prevent the production or use of evidence believed to be used in a prospective official proceeding by wiping trace evidence from a vehicle used during the incident on July 18, 2019.

In addition, SEAN ALBEA, 18, of Albany, and two separate 17-year-old Albany residents were each indicted on (2) Counts of Criminal Possession of a Firearm, each Class E Felonies, (2) Counts of Criminal Possession of a Weapon in the Second Degree, each Class C Armed Violent Felonies, and (1) Count of Criminal Possession of a Firearm, a Class E Felony. The indictment alleges that on September 22, 2019, at approximately 6:00 A.M., at 565 Clinton Avenue in the City of Albany, ALBEA did recklessly engage in conduct which creates a grave risk of death to another person by firing a pistol in a densely populated city neighborhood. On the same date, time, and location, ALBEA and the same two 17-year-olds allegedly did possess a loaded and operable Smith and Wesson 9 millimeter pistol and a loaded and operable Taurus .40 caliber pistol. Additionally, ALBEA and one of the above referenced 17-year-olds are alleged to have possessed a .38 caliber revolver.

ALBEA was also indicted on (1) Count of Reckless Endangerment in the First Degree, a Class D Felony in relation to the above named incident.

The above named and referred to charged parties are scheduled to appear in Albany County Court before Judge William A. Carter any time after 9 A.M. on Friday, December 13, 2019 for the purposes of formal arraignment.

Assistant District Attorney Michael Shanley of the Major Offense Unit is handling the prosecution of this case.
