Trespass Affidavit Program

The Trespass Affidavit Program is designed to fight against individuals loitering on posted property.

The Trespass Affidavit Program is one that requires an active role to be played by property owners by contacting the District Attorney’s Office and asking to be included in the program.  Upon contacting the District Attorney’s Office, property owners will be provided with an affidavit that must be filled out by the property owner(s) and returned to the District Attorney’s Office along with a list of registered tenants and a check or money order for $7.00 per sign for the Trespass Affidavit signs.  Once that information is received, it will be filed with the District Attorney’s Office and the County Police Department.  The sign will then be sent to the property owner(s) for the property listed on the affidavit. 

It will read:

No Trespassing
This building is for tenants and their guests only
Safe Homes – Safe Streets Trespass Affidavit Program
To report any violations call (number)
 

This sign should be adhered to the property in a location that is easily seen to ensure that police officers patrolling the area will be able to see what residences are registered in the program.  The posted signs will allow police officers to make basic inquires of any persons loitering on or around that premises, including the stoop or stairs attached thereto.  If any of those people live at the residence, are family of those living at the residence or are guests of those living at the residence then the officers will not ask that those persons leave the premises.  If the individuals do not belong on the property the officers are able to arrest those persons for trespassing.  If an arrest does occur, the police officer making the arrest must fill out a deposition in support of the reasons for the arrest and attach the affidavit for the property.  This information will then be given to the District Attorney’s Office and it will proceed accordingly.

Please fill out one affidavit per property and include all residents on the sheet for the registered tenants. Please photocopy and use additional sheets should you need to but be sure to put the property address at the top. Attach all sheets together with a check or money order payable to the Albany County District Attorney’s Office in the amount of $7.00 per sign to be posted on the property and mail the information to:
