Guilty Plea in Watervliet Burglary Spree

 

 

 

 

 

ALBANY, NY – District Attorney P. David Soares announced today that MARQUIS NESMITH, 29, of Troy, pleaded guilty to (1) Count of Attempted Burglary in the 2nd Degree, a Class D Violent Felony, before the Honorable Judge William A. Carter in Albany County Court last week.

On June 20, 2017, at approximately 9:30 P.M, in the area of 19th street, in the city of Watervliet, Count of Albany, NESMITH unlawfully entered the home of a person who was not known to him, taking various collectibles and property totaling an amount of approximately $1,000.

In a separate incident, on June 21, 2017, at approximately 12:30 A.M, on the 900 block of Broadway, in the city of Watervliet, County of Albany, NESMITH unlawfully entered the home of another person who was not known to him. NESMITH was stopped by the resident before he could gain entry and was later identified and arrested.

NESMITH faces up to 4 years in State Prison, to be followed by 5 years of Post Release Supervision, as well as being ordered to pay $600 in restitution to the victims, when sentenced on September 22, 2017.

Assistant District Attorney Joseph Brucato of the Street Crimes Unit prosecuted this case.
