Hate Crime Against Elderly





 

 

ALBANY, NY - District Attorney P. David Soares announced today that DAWN RICCIARDI, 40, of Troy, NY, pleaded guilty to (1) Count of Attempted Robbery in the Second Degree, a Class D Violent Felony, and JASON KENNEDY, 37, of Troy, NY, pleaded guilty to (1) Count of Robbery in the Second Degree, a Class C Armed Violent Felony, before the Honorable William A. Carter in Albany County Court this morning. 

On October 16, 2017, at approximately 6:50 PM, at 911 Central Avenue (Sally Beauty Supply), in the City of Albany, KENNEDY did forcibly steal money from Sally Beauty Supply. KENNEDY did conspire with RICCIARDI to commit an armed robbery. They were staying at the Motel 6 in Watervliet, and walked to Westgate Plaza, where KENNEDY entered the store with a bb gun that looked real, pointed it at the clerk’s face and demanded money. He stated, “Give me everything in the register and don’t tell anyone or I am going to KILL you”. RICCIARDI stayed outside of the store acting as a look out. RICCIARDI and KENNEDY gave full confessions to the crime. 

RICCIARDI faces up to 3 years in State Prison, to be followed by 3 years of Post-Release Supervision when sentenced on JANUARY 3, 2018.

KENNEDY faces up to 6 years in State Prison, to be followed by 5 years of Post-Release Supervision, when sentenced on JANUARY 3, 2018

ALBANY, NY –
District Attorney P. David Soares announced today that FRANK CHRYSLER, 49, of Watervliet, pleaded guilty to (1) Count of Grand Larceny in the Third Degree, as a Hate Crime, a Class C Felony, before the Honorable Roger D. McDonough in Albany County Supreme Court this morning.

On October 10, 2014, at approximately 9:30 a.m., at 767 New Loudon Road (First Niagara Bank), in the Town of Latham, County of Albany, CHRYSLER did steal property valued in excess of $3,000, and did intentionally select the person against whom the offense was committed due to her age. CHRYSLER did bring a person who was known to him who suffers from a decreased mental state, to the bank, on two separate occasions, and had her withdraw $5,000, on each occasion. He took said amount without permission to do so. All transactions are on video.

Between February and November of 2014, CHRYSLER, along with other co-conspirators, (HENRY HICKS, JOHN WATERSON, SUSAN BARR, BRIAN BARR, JOHN RISTO, and, JESSICA PARADISO) performed work under false pretenses for victims at their respective homes. They targeted said victims (all elderly) throughout Albany County (Bethlehem, Albany, Colonie). The estimated theft from all victims is in excess of $40,000. CHRYSLER is the last of the conspirators to be sentenced.

CHRYSLER faces 6-12 years in State Prison when sentenced on December 22, 2017.

Street Crimes Unit Bureau Chief Jessica Blain-Lewis prosecuted this case.
