Unlicensed Operation Cases





 

 

ALBANY, NY- District Attorney P. David Soares announced today the resolution of two vehicular crime cases in Albany County Court.

BRENDA HILL, 49, of Sloansville, NY was sentenced to one year in Albany County Jail, before the Honorable Peter A. Lynch in Albany County Court.

On August 25, 2017, HILL pleaded guilty to (1) Count of Aggravated Unlicensed Operation of a Motor Vehicle in the 1st Degree, a Class E Felony, (2) Counts of Driving While Intoxicated, a Class E Felony, and (1) Count of Circumvention of an Interlock Device, a Class A Misdemeanor.

On March 24, 2017, at approximately 5:00 AM, on State Route 9W, in the Town of Bethlehem, County of Albany, HILL did operate a vehicle under the influence of alcohol, while knowing that her license was revoked, and without a court ordered interlock device. A traffic stop was initiated due a civilian complaint for an erratic driver. At the stop, she displayed signs of intoxication and admitted to having several mixed drinks. HILL failed field sobriety tests and had a blood alcohol content level of .11. This was HILL’S fifth drinking and driving related offense.

HILL was on probation at the time of the March arrest for a 2014 Felony DWI conviction in Schoharie County.

Assistant District Attorney Michael Shanley of the Vehicular Crimes Unit prosecuted this case.

Finally, JOSEPH CARPENTER, 34, of Albany, pleaded guilty to (1) Count of Driving While Intoxicated, a Class D Felony, and (1) Count of Driving While Intoxicated, an unclassified misdemeanor, before the Honorable William A. Carter in Albany County Court.

On March 28, 2017, at approximately 2:20 A.M., on Oak Circle, in the Town of Colonie, County of Albany, CARPENTER did operate a vehicle in an intoxicated condition, while knowing his license had three or more suspensions. Officers stopped CARPENTER for a broken headlight and noticed signs of intoxication. CARPENTER admitted to having consumed one beer, failed three field sobriety tests and provided a breath sample yielding a blood alcohol content level of .16. CARPENTER was arrested for DWI.

CARPENTER faces 9 months to 1 year in Albany County Jail when sentenced on January 5, 2018 and upon release will be in Drug Court.
