Guilty Verdict under Leandra’s Law and 


Endangering of a Child




 

 

ALBANY, NY - District Attorney P. David Soares announced today that DAWN RICCIARDI, 40, of Troy, NY, pleaded guilty to (1) Count of Attempted Robbery in the Second Degree, a Class D Violent Felony, and JASON KENNEDY, 37, of Troy, NY, pleaded guilty to (1) Count of Robbery in the Second Degree, a Class C Armed Violent Felony, before the Honorable William A. Carter in Albany County Court this morning. 

On October 16, 2017, at approximately 6:50 PM, at 911 Central Avenue (Sally Beauty Supply), in the City of Albany, KENNEDY did forcibly steal money from Sally Beauty Supply. KENNEDY did conspire with RICCIARDI to commit an armed robbery. They were staying at the Motel 6 in Watervliet, and walked to Westgate Plaza, where KENNEDY entered the store with a bb gun that looked real, pointed it at the clerk’s face and demanded money. He stated, “Give me everything in the register and don’t tell anyone or I am going to KILL you”. RICCIARDI stayed outside of the store acting as a look out. RICCIARDI and KENNEDY gave full confessions to the crime. 

RICCIARDI faces up to 3 years in State Prison, to be followed by 3 years of Post-Release Supervision when sentenced on JANUARY 3, 2018.

KENNEDY faces up to 6 years in State Prison, to be followed by 5 years of Post-Release Supervision, when sentenced on JANUARY 3, 2018

District Attorney P. David Soares announced today that DAYNA VIZOYAN, 37, of Watervliet, was found guilty after a bench trial of (1) Count of Aggravated Driving While Intoxicated; Child in Vehicle, a Class E Felony, and (1) Count of Endangering the Welfare of a Child, a Class A Misdemeanor, before the Honorable Richard McNally in Albany County Court yesterday afternoon.

On July 10, 2016, at approximately 6:34 PM, in the area of 24th Street, in the City of Watervliet, County of Albany, VIZOYAN did operate a vehicle while in an intoxicated condition and while having a child passenger in said vehicle. After having consumed a significant quantity of alcohol, VIZOYAN did attempt to back her vehicle against a curb, hit a utility pole, pulled forward and scrapped the passenger side of the vehicle. The child in the vehicle was unrestrained. Watervliet Police were called to the scene and VIZOYAN was taken into custody.

VIZOYAN faces up to 1 1/3- 4 years in State Prison when sentenced on January 23, 2018.

Vehicular Crimes Bureau Chief Mary Tanner-Richter prosecuted this case.
