Sentencing in Cohoes Burglary Case




 

 

ALBANY, NY - District Attorney P. David Soares announced today that DAWN RICCIARDI, 40, of Troy, NY, pleaded guilty to (1) Count of Attempted Robbery in the Second Degree, a Class D Violent Felony, and JASON KENNEDY, 37, of Troy, NY, pleaded guilty to (1) Count of Robbery in the Second Degree, a Class C Armed Violent Felony, before the Honorable William A. Carter in Albany County Court this morning. 

On October 16, 2017, at approximately 6:50 PM, at 911 Central Avenue (Sally Beauty Supply), in the City of Albany, KENNEDY did forcibly steal money from Sally Beauty Supply. KENNEDY did conspire with RICCIARDI to commit an armed robbery. They were staying at the Motel 6 in Watervliet, and walked to Westgate Plaza, where KENNEDY entered the store with a bb gun that looked real, pointed it at the clerk’s face and demanded money. He stated, “Give me everything in the register and don’t tell anyone or I am going to KILL you”. RICCIARDI stayed outside of the store acting as a look out. RICCIARDI and KENNEDY gave full confessions to the crime. 

RICCIARDI faces up to 3 years in State Prison, to be followed by 3 years of Post-Release Supervision when sentenced on JANUARY 3, 2018.

KENNEDY faces up to 6 years in State Prison, to be followed by 5 years of Post-Release Supervision, when sentenced on JANUARY 3, 2018

District Attorney P. David Soares announced today that SCOTT GILLIGAN, 48, of Cohoes, was sentenced to 2 1/3 to 7 years in State Prison, before the Honorable William A. Carter in Albany County Court this morning. GILLIGAN is eligible for the Department of Corrections “Shock” program, a 6-month boot camp that includes 108 hours of classes, group counseling, alcohol and substance abuse treatment, as well as physical training and work crews. Upon successful completion of the program inmates are released from prison. 

On October 2, 2017, GILLIGAN pleaded guilty to one (1) Count of Burglary in the Third Degree, Illegal Entry With Intent to Commit A Crime, a Class D Felony. 

On January 22, 2016, between approximately 12:30 PM and 1:20 PM, on Lark Street, in the City of Cohoes, GILLIGAN did knowingly and unlawfully enter a home with the intent to commit a crime. GILLIGAN did break into the home of a person who was known to him by kicking in the back basement door and breaking the window. During the incident, he stole a flat screen TV, Apple IPads, an Apple TV, and a laptop, totaling to approximately $7,000. GILLIGAN was located in the City of Troy on the above said date with the stolen items visible in the vehicle he was operating and was charged.

Assistant District Attorney Benjamin Mastaitis of the Financial Crimes Unit prosecuted this case.
