Man Pleads Guilty to Robbing Family Dollar Store

 While Brandishing Hammer





ALBANY, NY- District Attorney P. David Soares announced today that LUIS NIEVES, 37, of Albany, pleaded guilty to (1) Count of Attempted Robbery in the First Degree, a Class C Violent Felony, before the Honorable Roger D. McDonough yesterday in Albany County Court.

On December 6, 2017 at approximately 9:45 A.M., NIEVES entered the Family Dollar Store located on Delaware Avenue in the City of Albany and stole a claw hammer. NIEVES then proceeded to brandish the hammer to a clerk and a store customer while demanding money. NIEVES forcibly stole money from the customer and then forced the clerk to open the cash register. NIEVES then stole US currency from the cash register and fled the scene. Members of the Albany Police Department arrived to investigate and later identified NIEVES as the robber. A search of NIEVES’ home uncovered the hammer that was used during the incident.

NIEVES faces 9 years in State Prison, to be followed by 5 years of Post-Release Supervision, when sentenced on April 6, 2018.

Assistant District Attorney Joseph Brucato of the Major Offense Bureau is prosecuting this case.
