 Stillwater Man Sentenced for DWI in Albany





ALBANY, NY- District Attorney P. David Soares announced today that JOSEPH GETHINS, 24, of Stillwater, NY, was sentenced to 1 1/3 to 4 years in State Prison, the maximum sentence, before the Honorable William A. Carter yesterday morning.

On January 3, 2018, GETHINS pleaded guilty to (1) Count of Driving While Intoxicated, a Class E Felony, (1) Count of Aggravated Unlicensed Operation of a Vehicle in the First Degree, a Class E Felony, (1) Count of Refusal to Take a Breath Test, a Traffic Infraction, (1) Count of Circumvention of an Interlock Device, a Class A Misdemeanor, and (1) Count of Assault in the Third Degree, a Class A Misdemeanor.

On April 1, 2017, at approximately 9:15 PM , on Ontario Street in the City of Albany, GETHINS, while intoxicated, drove the wrong way down the one way street when he collided with another car, totaling it and causing injuries to the victim. At the time of the incident, GETHINS did not have a court ordered ignition interlock device required to be in his vehicle, an open container of beer, and refused to submit a breath test to responding officers of the Albany Police Department. Additionally, GETHINS’ license was revoked for a prior 2012 DWI conviction in Stillwater, NY.

Assistant District Attorney Michael Shanley of the Vehicular Crimes Unit handled the prosecution of this case.
