Driver with Revoked License Pleads Guilty

 to Leandra’s Law


ALBANY, NY- District Attorney P. David Soares announced today that CARLOS COLON, 34, of Amsterdam, NY, pleaded guilty to (1) Count of Aggravated Driving While Intoxicated: With a Child Passenger Less than 16, a Class E Felony, and (1) Count of Circumvention of Interlock Device, a Class A Misdemeanor, before the Honorable William A. Carter in Albany County Court this morning.

On March 16, 2018, at approximately 11:36 P.M., while conducting a DWI checkpoint on Interstate 87 in the City of Albany, officers of the New York State Police stopped the vehicle COLON was driving and detected an odor of alcohol coming from inside of the vehicle. COLON failed field sobriety tests and admitted to consuming two alcoholic beverages before operating the vehicle. At the time of the incident COLON was driving with his three children, all under the age of 15, in the vehicle. Approximately one hour after the traffic stop, COLON had a blood alcohol content level of .10. At the time of the incident COLON was driving with a revoked license stemming from a 2013Aggravated DWI conviction.

COLON faces 1 to 3 years in State Prison when sentenced on December 5, 2018. Additionally, COLON will be subject to the installation of an ignition interlock device for 5 years upon release from custody.

Vehicular Crimes Bureau Chief Mary Tanner-Richter is handling the prosecution of this case.
