  Sentencing in Albany Burglary Case Where

 Resident Detained Suspect 


ALBANY, NY - District Attorney P. David Soares announced today that DEVON GIBSON, 47, of Albany, was sentenced to 8 years in State Prison, to be followed by 5 years of Post-Release Supervision, before the Honorable Roger D. McDonough in Albany County Supreme Court this morning.

On March 1, 2019, GIBSON pleaded guilty to (1) Count of Burglary in the Second Degree, a Class C Violent Felony.

On January 3, 2018, at approximately 11:45 P.M., GIBSON unlawfully entered an occupied residence on North Allen Street in the City of Albany to steal property. The residents woke up to find GIBSON inside and called 911. Members of the Albany Police Department responded to the scene while the crime was still in progress and the suspect was being detained by one of the residents.

This is GIBSON’s fourth burglary related criminal conviction and was deemed a predicate felon at sentencing today.

Assistant District Attorney Joseph Brucato of the Major Crimes Unit prosecuted this case.
