  Jury Returns Guilty Verdict in

 South Pearl Street Burglary


ALBANY, NY - District Attorney P. David Soares announced today that DAQUAN SMITH, 29, of Albany, was found guilty after a jury trial of (1) Count of Burglary in the Second Degree, a Class C Felony, and (1) Count of Criminal Contempt in the First Degree, a Class E Felony, before the Honorable Peter A. Lynch in Albany County Supreme Court yesterday afternoon.

After thorough deliberation and review of the evidence presented during the trial, the jury found that during the midnight hour of July 1, 2018 at a residence on South Pearl Street in the City of Albany, SMITH did knowingly and unlawfully enter a building with the intent to commit a crime therein. Additionally, SMITH did intentionally place a person who was known to him in reasonable fear of death, imminent serious physical injury or physical injury when he broke down the back door to the individuals apartment and chased her through the home in violation of a full stay away No Contact Order of Protection.

SMITH faces up to 15 years in State Prison when sentenced on August 5, 2019.

Assistant District Attorney Caroline Murray of the Special Victims Unit is handling the prosecution of this case.
