 Sentencing in South Pearl Street Burglary




  


ALBANY, NY - District Attorney P. David Soares announced today that DAQUAN SMITH, 29, of Albany, was sentenced to 10 years in State Prison, to be followed by 5 years of Post-Release Supervision, before the Honorable Peter A. Lynch in Albany County Court this morning.

On July 10, SMITH was found guilty after a jury trial of (1) Count of Burglary in the Second Degree, a Class C Felony, and (1) Count of Criminal Contempt in the First Degree, a Class E Felony.

After thorough deliberation and review of the evidence presented during the trial, the jury found that during the midnight hours of July 1, 2018 at a residence on South Pearl Street in the City of Albany, SMITH knowingly and unlawfully entered a building with the intent to commit a crime therein. Additionally, SMITH intentionally placed a person who was known to him in reasonable fear of death, imminent serious physical injury or physical injury when he broke down the back door to the individual’s apartment and chased her through the home in violation of a full stay away No Contact Order of Protection.

Assistant District Attorney Caroline Murray of the Special Victims Unit handled the prosecution of this case.
