 Misdemeanor DWI Case


ALBANY, NY - District Attorney P. David Soares announced today that ARIC LEMON, 40, of Watervliet, was found guilty after a jury trial of (1) Count of Driving While Intoxicated, a Misdemeanor, (1) Count of Operating a Motor Vehicle with .08 of 1% of Alcohol or More, a Misdemeanor, and (1) Count of Speed Violation, a Traffic Infraction, before the Honorable Bryan Clenahan in Guilderland Town Court yesterday afternoon.

After thorough deliberation and review of the presented evidence, the jury found that on April 15, 2018, at approximately 2:15 AM, on Interstate 87 in the Town of Guilderland, officers observed LEMON traveling at a speed of approximately 86 miles per hour in a 65 miles per hour zone. Following a traffic stop, officers observed LEMON exhibiting physical signs of intoxication. LEMON failed all standardized field sobriety tests at the scene and later registered a blood alcohol content level of 0.11%.

Following the verdict, the Court sentenced LEMON to participation in the Impaired Driver Program, the installation of an Ignition Interlock device, and participation at a Victim Impact Panel. LEMON must also pay fines and surcharges.
