 Sentencing in Guilderland 


Vehicular Assault Case




  


ALBANY, NY - District Attorney P. David Soares announced today that JUSTIN BALICKI, 26, of Albany, was sentenced to 2 1/3 to 7 years in State Prison, before the Honorable William A. Carter in Albany County Court this morning.

Additionally, BALICKI will be subject to license revocation subject to the determinations of the New York State Department of Motor Vehicles, the installation of an ignition interlock device for 3 years upon release, as well as attending a Victim Impact Panel, Impaired Driver Program and a fine.

On August 08, 2019, BALICKI pleaded guilty to (1) Count of Vehicular Assault in the First Degree, a Class D Felony.

On May 25, 2019, at approximately 7:00 AM, while traveling on Johnston Road in the Town of Guilderland, BALICKI operated a vehicle in a manner that caused serious physical injury to another person. Specifically, on the above stated date and location, BALICKI struck another vehicle head-on causing the person in the other vehicle to sustain a broken elbow, wrist, clavicle, and foot. The victim was treated for their injuries. At the time of this incident, BALICKI was operating a motor vehicle with a blood alcohol content of .26%.

Assistant District Attorney Collin D’Arcy of the Vehicular Crimes Unit handled the prosecution of this case.
