Multiple Cases in

 

Albany County Court This Week


 

ALBANY, NY -  District Attorney P. David Soares announced today that there have been multiple cases heard in Albany County Court this week involving gun crimes.

In addition to two cases being resolved in Albany County Family Court for weapons related incidents, one case was also submitted for a felony level alternative to incarceration program based on age and facts surrounding the incident. There have also been multiple Discovery and Certificate of Compliance matters before the Court, in addition to bail hearings and case conferences.

Notable illegal weapons cases heard in County Court this week include:

On November 20, 2020, ABUTALEB SIDIG, 23, of Colonie, pleaded guilty to (1) Count of Attempted Criminal Possession of a Weapon in the Second Degree, a class D Armed Violent Felony, before the Honorable Roger D. McDonough. On July 4, 2020, SIDIG was illegally operating an off road all-terrain vehicle on the roadway when he crashed in to a parked car on Second Street in the City of Albany. Officers responding to the crash scene uncovered SIDIG to be in illegal possession of a loaded handgun. SIDIG faces 3 ½ years in State Prison, to be followed by 5 years of Post-Release Supervision, when sentenced on January 8, 2021. Assistant District Attorney Megan Spillane is handling the prosecution of this case.

On November 19, 2020, KYANTE SEALEY, 20, of Albany, pleaded guilty to (2) Counts of Criminal Possession of a Weapon in the Second Degree, each Class C Armed Violent Felonies, before the Honorable Andra Ackerman. The plea of guilty fully satisfies several open illegal weapons possession cases against SEALEY. On August 26, 2019, at approximately 5:34 P.M., while in the area of South Pearl Street and Westerlo Street in the City of Albany, SEALEY intentionally fired a loaded semi-automatic handgun at a person, ultimately striking the victim in the leg. In addition, on April 12, 2020, at approximately 11:50 A.M., in the area of Orange Street and Lexington Avenue, in the City of Albany, SEALEY illegally possessed a loaded firearm, in addition to an incident on April 15, 2020, at approximately 11:05 A.M., in the area of 7 Lexington Avenue, in the City of Albany, where SEALEY was again in illegal possession of a firearm when he shot at a moving vehicle. No injuries were reported during the incident. The following day on April 16, 2020 at approximately 5:30 P.M., in the area of 228 Second Street, in the City of Albany, SEALEY was taken into custody by the Albany Police Department during a traffic stop. During the stop SEALEY was allegedly found to be in illegal possession of a loaded .22 caliber revolver which was concealed in his pants pocket. SEALY was remanded at that time and has been in custody since April 16, 2020. SEALEY faces 9 to 12 years in State Prison, to be followed by 5 years of Post-Release Supervision, when sentenced on January 19, 2021. Assistant District Attorney David Szalda is handling the prosecution of this case.

Also on November 19, 2020, DUSHAWN SIMS, 25, of Albany, pleaded guilty to a single count indictment of (1) Count of Criminal Possession of a Weapon in the Second Degree, a class C Armed Violent Felony, before the Honorable William A. Carter. An investigation by the Albany Police Department uncovered SIMS to be in illegal possession of a loaded firearm related to a June 18, 2020 shooting on Albany Street in the City of Albany. SIMS faces a sentence under discretion of the Court to a range of 3 ½ to 15 years in State Prison, when sentenced on January 14, 2021. Assistant District Attorney David Szalda is handling the prosecution of this case.

In addition, on November 17, 2020, JAMEIR DRAKE, 18, of Albany, was arraigned on (1) Count of Criminal Possession of a Weapon in the Second Degree, a class C Armed Violent Felony, (1) Count of Criminal Possession of a Controlled Substance in the Second Degree, a class A Felony, (1) Count of Criminal Possession of a Controlled Substance in the Third Degree, a class B Felony, and (1) Count of Criminal Possession of Stolen Property in the Fourth Degree, a class E Felony, before the Honorable William A. Carter. On September 12, 2020, at approximately 8:30 A.M., while inside a vehicle on Rawson Street in the City of Albany, DRAKE was found to be in possession of a loaded revolver handgun, in addition to multiple baggies that contained a quantity of cocaine. An additional handgun that was previously reported stolen was also recovered inside the vehicle during the search and investigation. DRAKE pleaded not guilty to the charges at arraignment at is currently in custody pending bail posting. Assistant District Attorney Megan Spillane is handling the prosecution of this case.
