Case Resolutions on Notable Illegal Gun


 Possession Cases in Albany County Court



ALBANY, NY -  District Attorney P. David Soares announced today that among the cases that are slowly moving back on track in the court systems, several notable gun violence related cases have been resolved in Albany County Court as appearances are being placed back on the Court calendars.

On February 25, 2021, KEVIN SHANNON, 42, of Albany, pleaded guilty to (1) Count of Attempted Criminal Possession of a Weapon in the Second Degree, a Class D Armed Felony, before the Honorable Andra Ackerman in Albany County Court. On August 25, 2020, an investigation led by the Albany Police Department uncovered SHANNON was in possession of a backpack that contained a loaded pistol. At the time SHANNON was on Parole and unable to possess a firearm. SHANNON faces up to 6 ½ years in State Prison, to be followed by (5) years of Post-Release Supervision, when sentenced on April 29, 2021.

Assistant District Attorney Joseph Brucato of the Major Offense Unit is prosecuting this case.

In addition, on February 26, 2021, EARL PITTMAN, 40, of Schenectady, was sentenced to (8) years in State Prison, to be followed by (5) years of Post-Release Supervision, before the Honorable Roger D. McDonough in Albany County Supreme Court. PITTMAN previously pleaded guilty to (1) Count of Criminal Possession of a Weapon in the Second Degree, a Class C Armed Felony.

On September 15, 2019, at approximately 2:21 A.M., PITTMAN was operating a motor vehicle on Central Avenue in the town of Colonie when officers conducted a traffic stop. Police found that PITMMAN was driving while his license was revoked due to numerous suspensions to his driving privileges. During the stop, officers recovered an illegally possessed firearm in the vehicle. Further investigation revealed that PITTMAN had multiple open drunk driving related offenses and convictions, including a pending sentencing for Felony DWI in Albany County Court that week, and an additional pending Felony DWI case in Saratoga County.

Assistant District Attorney Collin D’Arcy prosecuted this case.

In addition, on March 3, 2021, GREGORIE SMITH JR., 55, of Albany, was sentenced to 3 ½ years in State Prison, to be followed by (3) years of Post-Release Supervision, before the Honorable William A. Carter in Albany County Court. SMITH JR. previously pleaded guilty to (1) Count of Attempted Criminal Possession of a Weapon in the Second Degree, a Class D Armed Violent Felony.

On June 13, 2020, at approximately 9:40 P.M., SMITH was handling an illegally possessed firearm in his 14-year-old son’s bedroom while his son was present. SMITH discharged the weapon and a bullet went through a wall and struck his 10-year-old daughter in the back. The child thankfully survived the incident, and underwent surgery to treat injuries where the bullet entered her spine. Further investigation revealed that SMITH was unable to possess the firearm due to multiple previous felony convictions. The weapon was recovered hidden in the backyard of the home.
