Grand Jury Arraignments

in Albany County Court

ALBANY, NY - District Attorney P. David Soares announced today that several arraignments took place this week in Albany County Court as Grand Jury presentations have resumed. Among the cases, of note are:

JOSEPH EVANS JR., 20, of Cohoes, was arraigned on a sealed indictment charging (4) Counts of Criminal Sale of a Controlled Substance in the Third Degree, as Class B Felonies, before the Honorable Judge William A. Carter on Monday March 22, 2021.

An Albany County Grand Jury previously returned a sealed indictment alleging that EVANS sold a quantity of cocaine at various locations in the City of Cohoes on four separate dates in January and February, 2021. A warrant was issued for EVANS’ arrest and he was apprehended in Troy after evading capture from the US Marshall Service.

EVANS was out on bail at the time of the alleged drug sales for an unrelated shooting case. On June 30, 2020, in the area of 27 Lansing Street in the City of Cohoes, EVANS was allegedly in illegal possession of a firearm, and was subsequently indicted on (1) Count of Criminal Possession of a Weapon in the Second Degree, a Class C Armed Violent Felony, for his alleged role in a shooting incident that took place that day. EVANS posted bail and was released after arraignment in November 2020. During the arraignment this week the Court revoked the previously set bail and EVANS is now remanded into custody.

Assistant District Attorney David Szalda and Assistant District Attorney Bryanne Perlanski are handling the prosecution of these cases.

In an unrelated case, MICHAEL GREEN, 35, of Ballston Spa, was arraigned on (1) Count of Attempted Murder in the Second Degree, a Class B Violent Felony, and (1) Count of Criminal Possession of a Weapon in the Second Degree, a Class C Armed Violent Felony, before the Honorable William A. Carter in Albany County Court today.

An Albany County Grand Jury returned an indictment alleging that on April 13, 2020, at approximately 6:25 P.M., GREEN was in illegal possession of a firearm and intentionally attempted to cause the death of another person. While in a moving vehicle, GREEN shot multiple rounds from a handgun at the residence of 119 Old Loudon Road in the Town of Colonie.

GREEN pleaded not guilty to the charges and was continued on a previous $100k bond posting. There are no scheduled appearance dates set at this time.

Assistant District Attorney Joseph Brucato of the Major Offense Unit is prosecuting this case.
