 Guilty Pleas in Albany Day Care Shooting Case

 

ALBANY, NY -  District Attorney P. David Soares announced today that the case involving the shooting of a firearm in to a day care in the City of Albany has resulted in two guilty plea convictions.

BAHKEE GREEN, 18, of Albany, pleaded guilty to (1) Count of Criminal Possession of a Weapon in the Second Degree, a Class C Armed Violent Felony, before the Honorable Judge Thomas A. Breslin in Albany County Court on February 5, 2020. GREEN faces (7) years in State Prison, to be followed by (5) years of Post-Release Supervision, when sentenced on April 2, 2020.

On July 18, 2019, while in the area of Teunis Street and Third Avenue in the City of Albany, GREEN and a 17-year-old co-defendant, also of Albany, illegally possessed a loaded and operable pistol. The weapon was discharged and bullets traveled though the exterior wall of a day care, striking a three year old child who was sleeping inside. The child was treated and survived. The 17-year-old was also charged with preventing the production or use of evidence believed to be used in a prospective official proceeding by wiping trace evidence from a vehicle used during that incident.

The same 17-year-old was also charged in relation to a shooting incident that occurred on July 2, 2019, while in the area of 158 Third Avenue in the City of Albany.

The 17-year-old pleaded guilty to (1) Count of Criminal Possession of a Weapon in the Second Degree, a Class C Armed Violent Felony, before the Honorable Judge Thomas A. Breslin in Albany County Court this morning. He faces (10 ½) years in State Prison, to be followed by (5) years of Post-Release Supervision, when sentenced on April 14, 2020. The guilty plea today satisfies all open charges against this defendant.
