Guilty Plea for Multiple Violent Crimes

ALBANY, NY – District Attorney P. David Soares announced today that ALISTON SIMON, 35, of Albany, pleaded guilty to (1) Count of Assault in the First Degree, a Class B Violent Felony, and (1) Count of Kidnapping in the Second Degree, a Class B Felony, before the Honorable Roger D. McDonough in Albany County Court this afternoon for his role in several violent crimes in the City of Albany.

At approximately 8:50 a.m., on or about May 6, 2020, while at 25 Lincoln Avenue, in the City of Albany, SIMON did display a machete in an attempt to cause reasonable fear of serious physical injury to another person. SIMON was issued an appearance ticket after the incident and did not appear for his arraignment. A bench warrant was subsequently issued for his arrest.

Additionally, on June 1, 2020, while in a residence on North Pearl Street in the City of Albany, ALSTON abducted a woman and 1 year-old-child who were known to him and exposed them to risk of serious physical injury while restraining them. When police arrived at the scene SIMON slashed a responding officer with an 8 inch knife on the wrist, which resulted in physical injury. At the time of initial arraignment the People requested $35,000 bail be set, but instead the Court released this defendant under the supervision of the Probation Department.

While out of custody on the above listed charges, SIMON attempted to cause the death of a person that was known to him while in the area of 5 Lincoln Avenue on July 23, 2020 at approximately 4:00 p.m., by means of stabbing him. The adult male victim survived the attack after receiving emergency surgery.

The guilty plea today fully satisfies all charges pending against SIMON in Albany County. SIMON faces up to (18) years in State Prison, to be followed by (5) years of Post-Release Supervision, when sentenced on September 9, 2021.
