Guilty Verdict in Sex Abuse Case

58-year-old Carl Barton, formerly of Albany, was convicted of Criminal Sexual Act in the Second Degree, and Sexual Abuse in the Second Degree.

Albany, NY – 58-year-old Carl Barton, formerly of Albany, was convicted of Criminal Sexual Act in the Second Degree, and Sexual Abuse in the Second Degree this morning following a jury trial before the Hon. Roger McDonough in Albany County Supreme Court.


The indictment alleged that on or about November 30, 2020, while at a location on Morris Street in the City of Albany, the defendant engaged in sexual conduct with a person who was not capable of consent due to a mental disability. Sentencing is scheduled for May 31, 2024.


Assistant District Attorneys Caroline Murray, the Bureau Chief of the Special Victims Unit, and Alyssa Congdon are handling the prosecution of this case.
