Former Attorney Sentenced in Colonie Theft Case

A Superior Court Information alleged that between October 16, 2020, and July 14, 2021, while retained as an attorney to probate a will, he stole from the estate of a victim.

ALBANY, NY – 56-year-old Roy Nestler of Cohoes was sentenced to an indeterminate term of 4 to 12 years in State Prison before the Hon. Andra Ackerman in Albany County Court on Thursday, May 23, 2024.


Nestler previously pleaded guilty to Grand Larceny in the 2nd Degree, on May 23, 2023 with sentencing adjourned for 1 year.


A Superior Court Information alleged that between October 16, 2020, and July 14, 2021, while retained as an attorney to probate a will, he stole from the estate of a victim. Specifically, Nestler deposited over $1 million into his own business account, disbursed only $535,000 to the beneficiaries of the estate. An additional $512,000 was used for his own personal expenses, including his mortgage, and withdrawals at Saratoga Casino.


In addition to his sentence, Nestler was order to pay restitution to the Lawyer’s Fund for Client Protection, who paid over $400,000 to the victims.


Assistant District Attorney Linda Griggs handled the prosecution of this case.
