Enhanced Sentence in Albany Gun Case

Sentencing was originally scheduled for June 4, 2024, with an agreed-upon sentence of 8 years in State Prison. However, sentencing was adjourned until today and the term was enhanced by 2 years due to a violation of pre-sentence conditions by the defendant.

Albany, NY – 47-year-old Lee Childs of was sentenced to a determinate term of 10 years in State Prison, followed by 5 years of post-release supervision as a Predicate Felon before the Hon. William Little in Albany County Court this morning.


On March 11, 2024, Childs pleaded guilty to One Count of Criminal Possession of a Weapon in the Second Degree, which also satisfied any pending matters in Albany City Court.


As a part of his plea, Childs admitted that on or about June 18, 2023, in the area of 536 1st Street in the City of Albany, Childs knowingly possessed an illegal, loaded firearm.

Judge Little said:


“It is clear from the transcript from the PSI that his failure to accept responsibility… didn’t conform with anything he placed on the record. The statements made in the PSI are indicative of a history of Mr. Childs’ unwillingness to accept responsibility… Mr. Childs is an adult who can make decisions on his own. The fact that he was saying he’s being influenced by family members which prevented him from coming up (to court) shows absolute disrespect to the court process.”


Assistant District Attorneys Bryanne Perlanski and Jessica Blain-Lewis, the Bureau Chief of the Homicide and Violent Crimes Unit, handled the prosecution of this case.
