Sentencing in Sex Abuse Case

The indictment alleged that on or about November 30, 2020, while at a location on Morris Street in the City of Albany, the defendant engaged in sexual conduct with a person who was not capable of consent due to a mental disability.
Albany, NY – 58-year-old Carl Barton, formerly of Albany, was sentenced to 7 years in State Prison, followed by 15 years of post-release supervision as a Predicate Felon before the Hon. Roger McDonough in Albany County Supreme Court this morning. That sentence will run consecutive to an aggregate sentence of 30 years to Life the defendant is already serving for 2 prior felony convictions (25 to life for Predatory Sexual Assault, and 5 years for Attempted Criminal Possession of a Controlled Substance).
On April 18, 2024, Barton was convicted of Criminal Sexual Act in the Second Degree, and Sexual Abuse in the Second Degree, following a jury trial.

Judge McDonough said:
“This defendant has appeared before this court on two hideous cases… The defendant has shown himself, throughout his life, as demonstrated by his criminal history, to be a sexual predator… In the most diabolical way he is a predator, which is, he preys on individuals who are incapable of defending themselves… He is clearly an individual who cannot function in society without attempting to, or actually preying on other members of society”
Assistant District Attorneys Caroline Murray, the Bureau Chief of the Special Victims Unit, and Alyssa Congdon handled the prosecution of this case.
