Murder Indictment Unsealed

22-year-old Sincere Cancer of Albany pleaded Not Guilty to a 9-count indictment before the Hon. Thomas Marcelle in Albany County Supreme Court Friday morning.
Albany, NY – 22-year-old Sincere Cancer of Albany pleaded Not Guilty to a 9-count indictment before the Hon. Thomas Marcelle in Albany County Supreme Court Friday morning.
That indictment included One Count of Murder in the Second Degree, Two Counts of Attempted Robbery in the First Degree, Two Counts of Criminal Possession of a Weapon in the Second Degree, Two Counts of Criminal Possession of a Controlled Substance in the Fourth Degree, One Count of Criminal Possession of a Controlled Substance in the Third Degree, One Count of Reckless Endangerment in the First Degree,
The following crimes were alleged in the indictment, in order of their alleged commission:
-On or about May 24, 2021, in the area of Wilbur Street in the City of Albany, the defendant, or another participant, attempted to commit a gunpoint robbery, and either in furtherance of that crime, or of immediate flight, he, or another participant caused the death of a victim, specifically, Destiny Greene.
-On or about July 22, 2021, in the area of Lark and Orange Streets in the City of Albany, the defendant possessed a loaded, operable firearm, and recklessly engaged in conduct that created a grave risk of death to another person.
-On or about September 12, 2023, in the area of Trinity Place in the City of Albany, the defendant the defendant possessed on or more preparations, compounds, mixtures, or substances containing cocaine, which weighed 1/8 of an ounce or more. Additionally, the defendant possessed an illegal firearm on the same date and at the same location.
-On or about March 20, 2024, in the area of Second Street in the City of Albany, the defendant possessed on or more preparations, compounds, mixtures, or substances containing cocaine, which weighed 1/8 of an ounce or more, with the intent to sell it.
The defendant was remanded following Friday’s appearance, pending a formal bail application.
